Environmental Information Regulations Exemptions Guidance

This document is aimed at all University freedom of information practitioners, and any other staff who may handle environmental information requests and need to be aware of the exemptions available under the Environmental Information (Scotland) Regulations 2004. It gives an overview of the permissible exemptions, and explains the tests that apply to them (including substantial prejudice and the public interest test). Details of all the exemptions and their tests are given in Annex A. The guidance is intended to assist staff with taking decisions on whether to release environmental information. It should be used in conjunction with the guidance on receiving and replying to requests for information and the model letters pack.
